1. Agreement to Terms

By accessing or using TCG Snipe ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service, including our desktop application and website.

2. Description of Service

TCG Snipe is a SaaS application that provides:

• AI-powered trading card recognition
• Real-time pricing data from third-party sources (TCGPlayer, eBay)
• eBay affiliate link generation
• Card scan history and analytics

The Service is provided on a subscription basis with different tiers offering varying levels of access and features.

3. Account Registration

To use the Service, you must:

• Be at least 13 years of age
• Create an account with accurate information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account

You agree to notify us immediately of any unauthorized use of your account.

4. Subscription and Billing

4.1 Free Trial

New users receive a 3-day free trial with 10 total scans. A credit card is required to start the trial. If you do not cancel before the trial ends, you will automatically be charged for a Basic subscription ($5/month).

All payments are processed securely through Stripe. By subscribing, you authorize us to charge your payment method on a recurring monthly basis until you cancel.

4.4 Cancellation

You may cancel your subscription at any time from your account dashboard or Stripe billing portal. Cancellation takes effect at the end of your current billing period. No refunds are provided for partial months.

4.5 Refund Policy

We offer a 7-day money-back guarantee from the start of your paid subscription (after the trial ends). To request a refund, contact support@tcgsnipe.com within 7 days of your first charge.

5. Acceptable Use

You agree NOT to:

• Violate any laws or regulations
• Infringe on intellectual property rights
• Attempt to reverse engineer, decompile, or hack the Service
• Bypass rate limits or subscription restrictions
• Share your account credentials with others
• Use automated tools (bots, scrapers) to access the Service
• Resell or redistribute data obtained from the Service
• Use the Service for any fraudulent or malicious purpose

Violation of these terms may result in immediate suspension or termination of your account without refund.

6. Rate Limits and Fair Use

Each subscription tier includes daily scan limits and cooldown periods. These limits are enforced server-side and cannot be bypassed. Excessive usage that violates fair use principles may result in account suspension.

Limits reset daily at midnight UTC. Unused scans do not roll over to the next day.

7. Intellectual Property

7.1 Our IP

The Service, including its software, design, graphics, and content, is owned by TCG Snipe and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

7.2 Trading Card Trademarks

TCG Snipe is not affiliated with, endorsed by, or sponsored by:

• The Pokémon Company, Nintendo, or Game Freak
• Wizards of the Coast (Magic: The Gathering)
• Bandai (One Piece Card Game)

All trading card game names, logos, and trademarks are property of their respective owners. Our Service provides pricing information and is not affiliated with the manufacturers.

7.3 User Content

You retain ownership of card images you upload. By using the Service, you grant us a license to process and store these images for the purpose of providing card recognition and pricing services.

8. Third-Party Services

The Service integrates with third-party services for pricing data and affiliate links:

• TCGPlayer (via JustTCG API): Official card pricing
• eBay Partner Network: Market pricing and affiliate links
• AI Technology: Card recognition and validation

We are not responsible for the accuracy, reliability, or availability of third-party data. Pricing information is provided for informational purposes only and may not reflect current market conditions.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• Accuracy, reliability, or completeness of pricing data
• Uninterrupted or error-free operation
• Security or freedom from viruses or harmful components

You use the Service at your own risk. We do not guarantee that card recognition will be 100% accurate or that pricing data reflects current market values.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TCG SNIPE SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or goodwill
• Damages arising from your use or inability to use the Service
• Reliance on pricing data or card recognition results
• Unauthorized access to your account or data

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is less.

11. Indemnification

You agree to indemnify and hold harmless TCG Snipe from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any rights of another party.

12. Termination

We may terminate or suspend your account immediately, without prior notice, for any reason, including:

• Violation of these Terms
• Fraudulent or illegal activity
• Non-payment of fees
• Abuse of the Service

Upon termination, your right to use the Service will immediately cease. We are not obligated to provide refunds for terminated accounts.

13. Modifications to Service

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

14. Changes to Terms

We may revise these Terms at any time by updating this page. Your continued use of the Service after changes constitutes acceptance of the new Terms. We will notify you of material changes via email or in-app notification.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and TCG Snipe regarding the use of the Service, superseding any prior agreements.
